CONSOLIDATED DFT, et al Several class action were consolidated and apparently we now have the 2nd settlement, after a previous settlement in 2004 was rejected by the court. The docket to 7/15/06 7-14-06 Docket Progressive.pdf (209.8 k) Dawn Wheelahan seems to be a frequent objector to these crappy settlements and James, Hoyer deposed her in 10/04: Wheelahan depo 10-25-04--Wheelahan-depo.pdf (1705.1 k) The 2/23/05 ORDER rejecting the settlement. This is an EXCELLENT read and judge Paul rejected the settlement not only because the class notice failed to inform the class members of their right to object, but he found that the settlement was NOT fair. 2/23/05 ORDER 2-23-05-ORDER-denying-settlement.pdf (106.7 k) I've been reading filings and related cases by James, Hoyer all night and I'll try to post some more documents James, Hoyer conveniently does NOT post at the settlement site. If you should access the additional documents directly at PACER (all the docs and many depos of the objectors are online), please post the filings here. I don't have unlimited time and funds.
